Who can you obtain restraining orders against?
My ex has a problem with the friend of my father and do not want our children around her. To him to get his way, he has threatened to impose a restraining order against her to ensure that I will not allow that our children around her. She has never done anything wrong and does not deserve this treatment from him. Can he get one against it or is it a false threat?
You do not know what the law of your state, but in North Carolina, we have what is called a protection order 50C. 50B is an order for someone in a domestic situation (boyfriend / girlfriend, husband / wife). A 50C is a civil protection order against someone else. To obtain an order you 50C must go to the Clerk of the Court in your county and fill out a form stating the reasons you or your children need protection. A hearing date is fixed and both parties are advised to come to court and state court judge the district one of their side of the story. The judge then decides whether an order is necessary and what restrictions will be set. If the judge does not believe an order is required then it will not issue one. Hope this helps but you probably need to contact someone in your state for answers.
